Jeanine Pirro Files $250,000 Lawsuit Against Wealthy New York Suburb After She Tripped While Walking

The U.S. Attorney for the District of Columbia, Jeanine Pirro, is suing her hometown of Rye, New York, for $250,000 after she tripped and fell while walking.Ms. Pirro, a former Westchester County District attorney, state judge, and most recently, a Fox News star, says in her lawsuit that she “tripped and fell over a large wooden block embedded in and protruding from under a steel plate” while she was walking on the afternoon of August 28. The steel plate was placed there to cover excavation for work on a gas main that was being done by Consolidated Edison. “The hazardous condition over which [Judge Pirro] fell was caused by, arose out of, and was directly related to Con Edison’s construction and excavation activities, including the placement, use, and failure to properly secure the construction site for pedestrian traffic, and to remove or secure construction materials and the failure to restore the roadway to a safe and level condition,” Ms. Pirro’s lawsuit alleges. “The dangerous condition was not a mere transitory defect but arose from affirmative acts of negligence by the City of Rye in the performance and oversight of construction and roadway work and its breach of its duties to properly inspect and secure the roadway for pedestrians.”Images submitted as exhibits in the case show a block of wood near the steel plate, which appears to be in the street and not in a walkway, protruding slightly.As a result of the fall, which occurred weeks after she was confirmed to her position, Judge Pirro says she suffered “serious personal injuries, including but not limited to bruises and contusions to the head, eye, face, and shoulder areas, together with pain, discomfort, and limitation of movement.” She also says she was “confined to bed” and “continues to experience pain and suffering, inconvenience, loss of enjoyment of life, and economic damages.”Con Ed and Rye declined to comment. However, in a filing, an attorney for Rye insisted that it can “hardly be said that the City was negligent in a duty to pedestrians at a location that was not a pedestrian walkway.”Meanwhile, Con Ed filed a motion to dismiss Judge Pirro’s lawsuit and said that the hazards were “open, obvious, and apparent.”
