Atlantic Yards Opponents File Appeal

Opponents of the Atlantic Yards development in Brooklyn have filed an appeal in New York State Appellate Court, claiming that the lower court erred when it threw out their case last January. The 26 community groups, led by Develop Don’t Destroy Brooklyn, said in the appeal that the 22-acre site’s environmental impact analysis was flawed and that a new, “credible” analysis should take place under Governor Paterson.
State Supreme Court justice Joan Madden ruled against the group last January. Forest City Ratner’s Atlantic Yards project was approved in December 2006 under Governor Pataki’s administration, after the Empire State Development Corporation conducted an environmental review and approved it. The development is slated to include the home of the Brooklyn Nets basketball team as well as residential and retail spaces and commercial offices.
