they have just continued the sidestepping.

As in the last case MILLER V. where the court ruled that as a short-barreled shotgun was not an appropriate weapon for use my any military or militia (hardly the case anymore...) that therefore Miller's right to own a weapon did not apply FOR THIS WEAPON, they never stated he had no right to firearms, just that he did not have a right to have that particular type of weapon.

The interesting follow on for this will then be California's assault weapon ban. If the case finds that it is an individual right, and that it applies to states, what more truly fits the definition of a militia type and quality of weapon more so than an "assault" rifle?
