Brooklyn's D.A. Gets a Warning Over Office's Ethics Procedures

Submitted by Roland Thau, Feb 21, 2007 15:56

The "leaker" is said to have provided her defense lawyer fiance information which he used in cross examining a prosecution witness. Could it be that this information should have been given to the defense by the trial Assistant District Attorney under the Brady and Giglio rules which require that the prosecution disclosed to the defense exculpatory and or impeaching evidence, but that such evidence had been improperly withheld.

If that was the case, the "leaker" should be commended and the prosecutor(s) who withheld the exculpatory or impeaching evidence should be disciplined at the very least and possibly even disbarred.
