The defence cannot mention the illegality of the war?

That's like saying a defendant can't claim self-defence in a murder trial. It's ludicrous and clearly biased against the defence, and that is without mentioning the prejudices or the desultory and insulting remarks by the "judge".

While it's good that a mistrial was declared, it may only be a delay to enable the persecution - sorry, prosecution - to find an "acceptable" scope for an unacceptable charge.

The illegality of the war is the central issue. If that is denied, then you might as well send Watada to Guanatanamo where other unaccused kidnappees are held without trial.
